Ok, so i have had 3 months off recovering from an operation. I had the first 2 months paid in full and have continued to supply sick notes for the period of time that i have been off work. It was suggested by my employer that i use some holidays to top up my income this month as i would only be received SSP. I have just been paid today and i have only been paid the 3 weeks of holidays that i have put in to add to my income.

The question is, am i still entitled to SSP even though i have put holidays in to top up my income, not to replace the SSP?

Second question, do employers have to pay for the SSP or does the government pay them for it?

The employer pays you the SSP and then the Government compensates the employer by taking it off their National Insurance Contribution bill.

So - in the end it is the Gov that pays.

I'm not sure whether SSP and holiday pay would clash - but you should have had SSP for the remaining part of the month at least.

To answer your first question it would be extremely unusual to be receiving holiday pay and SSP at the same time. Technically you cannot be off sick and on holiday at once. Really your employer should just be paying you SSP and shouldn't have made the offer about using holiday pay.

Second question - the company pays the SSP - the government doesn't reimburse them so yes, it is costing them money while an employee is off sick.

You can`t have holiday pay and claim SSP. Go for the one which pays the most. if you don`t pay national insurance the government pay direct to you if you do pay insurance then your employer pays you then they have to claim it back from the government.
