Off work on long term sick.....?
I was diagnosed with bowel cancer last June. My line manager was getting quite sh*tty about me having time off for scans etc before I went into hospital for a bowel resection.
I went sick before I went into hospital last July, but, due to the cancer spreading further than they thought, I then had to have six months of chemotherapy. I was paid statutory sick pay by my employer up until January this year, and now I'm on Employment Support Allowance, with my next review on 22nd July.
I'm getting better all the time and am now thinking of going back to work....however.....
1. I have not heard ANYTHING from my line manager in all the time I've been off sick.
2. Every time I phone the firm, the girl I speak to says someone will ring me back ie. a manager or someone...they never have done and I've been trying to speak to someone for around four months now.
3. I've had a P60 from them, so presumably I'm technically still in their employ.
4. I need to know what's going on...whether I even have a job to go back to, or what they intend to do.
Would you want to go back to work for a firm like this? I must admit I don't, but then there's very little else in the line of work I do, although I am looking around. I can't stay on the sick forever, and I want to go back to work (ok...so I don't, but I really need to earn more money, rather than exist on handouts!)
Where do I stand, do you think? And what would you do in my shoes? I'm in remission, and there are no more health problems, apart from getting back to full fitness

Honestly, it sounds like you have had a lot more to worry about then what your employer is doing however I will help you out with what I can. I have been a Labor Union President for most of my life and I have dealt with situations like yours quite often throughout my career. I can tell you that you won't have anything to worry about from your employer with your condition being as serious as it is. If you were out for stress, migraines, or even depression then there would be a very good chance that your employer may try to do something to terminate your employment. However, when you have cancer and serious health conditions such as these the employer will be very hesitant to say or do anything derogatory due to the fact that they will be concerned of a possible lawsuit. You have 12 weeks a year available to you through the Family Medical Leave Act (FMLA) that protects your job when you are out from a serious illness. It was passed and signed into law by President Bill Clinton in 1993 and it is supposed to be 12 weeks of unpaid time. However, if you have either a Union contract or individual contract that guarantees you retain your salary during sickness and injury, then the time is paid and is still covered under FMLA and cannot be charged against you by Federal Law.
