Is it illegal not offer to a job internally?
Recently I noticed a change in some of the job titles of my co-workers. Their original positions were considered non-exempt and then I noticed their were given or promoted to the title of Sr.Managers. To me, just the title alone, Sr.Manager positions are usually considered exempt positions which can then be consider a step up or promotion. The problem I'm having is not that these people were promoted but that these Sr.Manager positions were never opened to company employees. Granted, some of the people who apply may not be qualified but I'm thinking they should have at least offered the positions for internal employees to apply. How else is someone able to advance other then hoping some manager will recognize the hard work he/she puts in and then decides they are worthy of a promotion. Even the positions that were vacated in exchange for the promotion are being filled by temps and not being offered to internal employees. I live California and I know we have more laws then any other state in the country. Is this form of business practice legal and does it violate any Equal Opportunity or Civil Right Laws?
