Can I collect unemployment if I had separate 1099 income earlier in the year?

My current employer is going into bankruptcy. Earlier this year I did some side work for someone else which I will get a 1099 for. I am no longer doing the side work. Can I still collect unemployment in Illinois for losing my current job even if I had misc. income earlier in the year?

If you have worked at a company/companies paying you based on W-2 wages, you may be eligible for benefits -- 18 months of work, sufficient income.

Your side job is of no consequence. It didn't include UI coverage so UI benefits will not take that into account.

As you didn't give us the name of the state in which you will claim benefits, we can't give you specific requirements you would need to fulfill. You should simply file for your UI benefits the evening of your last day of employment.

Absolutely! ...the key word here is "earlier this year". Your previous 1099 work has nothing to do with unemployment. Unemployment is based on existing work status, in this case your W2 work. So when/if your current employer goes under, you will still be able to get unemployment. Don't forget to ask for some sort of compensation prior to leaving, can't hurt to ask. Most have a fund set up just for this; sometimes the upper management get most of it, worth a try. -White Buffalo
