Could anyone give me advice or links to easily understandable information on sick leave in the work place? My mum suffers from two slipped and burst discs in her back causing a lot of pain and discomfort on certain days to the point where she can't walk but is fine on others. I would appreciate any advice on absence & sickness rights as although she has given certified medical letters she has received questionable 'warning letters' on her absence and I would be grateful to know if their is any law protecting her or to refer to?

In the US, she may be eligible for Family Medical Leave (FMLA). This allows 12 weeks off per year, unpaid, for medical conditions. The time can be taken all at once or a few hours here or there (called intermittent leave). To be eligible for FMLA she needs to work for an employee with at least 75 employees and she must have worked for at least 1 year. There are other requirements but the details are too much to include here.

Different companies have different "policies" on sick leave - most employers do not want to have an employee who only works on "good" days, but is too racked with pain to walk/work the very next day! Either your mother is suffering from a disability that keeps her from working full time or has been released by the Doctors treating her to work full time. Company policy is of no avail here, this is a medical problem.
