I recently bought a 60GB Sony PlayStation 3 2nd hand from a eBay private seller. It has been treated well and has been working fine until yesterday when it completely stopped working. I have contacted UK Sony support and have been told that I will have to pay £130 to swap my current PS3 for one of the same modal. Do I have any trade of goods act rights in this circumstance? I'm aware that it lasts up to six years after purchase but can this be resolved with the manufacturer? This modal Of Playstation in the original that was created back in 2007. They stopped making these in 2008. If it's nothing to do with the manufacturer do I then have to address the private seller from eBay?

A few points to make straight away:

1) Your contract is with the seller, not the manufacturer. You would have no redress against Sony even if it was new.

2) For the six year thing to apply to something like a PS3 you would have to show that it was down to a design fault rather than workmanship or materials. If it was something like a house or whatever you would have comeback over a longer period but consumer electronics is not expected to last forever.

3) The sale of goods act gives only limited protection to second hand purchases, especially from private sellers. If the goods are were as described when you bought them you have no redress.

Ultimately I think you are simply out of luck in all probability.

If there's no warrenty on it then youve got no comeback.

How long ago did you buy it?

If its week or months then its not really the sellers issue either unless you can prove it was either sold faulty or was not as described and then you could really only lodge a complaint with ebay as it would be a breach of listing policy if the fault wasnt mentioned or the system was sold as fully working
