Will my wife have to repay maternity leave pay?

I live in the U.S. and my wife is about to go on maternity leave. The company that she works for offers 6 weeks paid and 6 weeks unpaid (total of 12 weeks) maternity leave. However, my wife is thinking about quitting soon after returning to work. Her employer requires that she repay maternity pay if she does not return from maternity leave. But, how will they actually enforce this repayment? Can they take it from her 401K, or will they simply send her to collections or file a lawsuit? Also, does it make a difference if she returns for a couple weeks, and then quits? Thanks, in advance, for your answers.

If she violates an agreement to return to work in exchange for being paid they can sue her. |

I'd go back to work for a couple of weeks then quit. They cannot make her repay Maternity leave. Those benefits she has earned as law. They cannot touch your 401K at all. That's a totally different area. Don't let her get intimidated by them, but yet show humility and keep her plans a secret till it's time to quit her job. |
