What should I do with my boss not paying for my work?

I had no job for about 2 months and then I went to a college job fair and found a place to work. So then I the person interviewed me and I was accepted. Then they told me that they had just moved from another office and that I just had to work 5 hours a day, weekdays.

So, the dude was very unorganized, I almost never had anything to do, and he sometimes let me go home early and he would still pay me for the whole hours( 5). And so I just had to call residential homes and offer them a new internet service (Clear). I also did worksheets of telephone #s and names. We were told that we would get paid biweekly and that the first check was on May 1st, which I started in April 5.

The dude told me to print out the application after he emailed it to me and to have my info, like copy of my SS# and ID, as well as tax sheet, but when I wanted to turn it in he kept saying that I can turn it in later.

So then the dude then went out of town and then I got a better offer...working for the census....and I stopped going. I had to complete 50 hours of training and I did about 38! So May 1st comes and he didn't pay me, he says that he will call me at certain time and never does! after i call him he doesn't answer, or I actually think that he ignores my calls. I call from another # and he later answers and gives me the company #, which I didn't realize that he was making a line online for us to answer customers when they wanted the service, which he did WRONG! I think!!

So my dad says to call an attorney but IDK what to do! I guess Im gonna stalk him at the office but hes never there (according to him he's out in the field" recruiting customers or employees) so What should I do!

As an employer he has what's called and EIN number, (Employer Identification Number). He needs this by law to run a business. You don't have to know what that number is. Here are a few things to consider:

1) If he never accepted your W4 form for tax with holdings, then he committed a crime, (tax evasion). He also must report ALL new hires to the State an Federal government. If he didn't, he committed another crime.

2) Did you punch a time clock or fill out a time sheet?

3) Did he pay you by check? If so, you should have a check stub showing how many hours and at what rate per hour he paid you. Keep that check stub!

Now here's what you can do. Figure out how many hours you actually worked, and how many hours he paid you for. Calculate how many hours he still owes you. Type up a formal letter detailing this information. Have it notarized and send it to him RETURN RECEIPT REQUIRED. That means someone will have to sign for it on delivery. He won't be able to say he never received it. You might have to use some strong legally threatening language in this letter - because it's obvious he doesn't plan on paying you. Give him a specific time line as to when you expect to receive a check for the remaining hours he owes you for. Make it clear in your letter that if you don't receive it by (pick a date), you'll not only report him to your local state and federal IRS offices, you'll sue him for interest on what he owes you. This should get his attention. If it doesn't, then do this.

File a claim through the EEOC in your state for Wages Not Paid. You can go online to find the form you'll need to fill out. Once this is in the hands of the EEOC, they'll do a complete investigation of this company - and they'll help you get the wages this guy hasn't paid you for yet.

He's probably expecting you to just let it go. Don't! This guy needs to either be put out of business or needs to incur some hefty state and federal fines for the way he's 'running' his business.
