What are my rights? I was fired but it wasn't my fault?

I was fired from my job of almost 3 years because my bf got his hands on a company check and filled it out and stole $200... it was caught right away and I had NO idea about it. It was so humiliating!!! Anyway, they fired me a few weeks ago for this and I'm really upset about it because if you get fired you can't collect unemployment and I'm 4 months pregnant and NEED to collect some income. I told my boss to please not put I was fired because clearly I wasn't the one who did it and all she said was I'll see, but probably not because "that would be a lie", my bf even called my boss and confessed that he did it and that I didn't know about it and paid back the $200.

Honestly I'm over being super upset about this because I spent so much time being upset about it already... that all I want to know is what are my rights? Can I collect unemployment still even if I was fired for something I didn't do or even know about? I was reading that if YOU steal from your company then you can't collect unemployment, but I wasn't the one who stole.

Please help.... I can't get a job now that I'm this far along pregnant, no one wants to hire me and I need to collect SOME income???

Unfortunately, unless you had a contract, you have no rights. You can't get unemployment if you were fired.

I am sorry but it is in a way your fault. How did you bf get a hold of the company check ? If you were not involved directly than you were negligent of your duty and company property. I think you are lucky the company did not press charge. It is time for your bf to support you because of his fault.

Take your plea to the unemployment office. They will be able to tell you for sure. You never know until you ask. Please don't take these people word as God. So many people post, "You can't get unemployment if you are fired," but many states have exceptions. You are not going to know unless you try to file a claim and get it all figured out. There is no harm in trying.

In a nutshell, you have to prove that you did not breach your contract, or that if you did, the breach was not fundamental. On the latter question you are sunk. On the former, more details are required.

If your boyfriend did this in some way that you did not know and you could not know that it happened, then I suspect that would not be cause for dismissal. On the other hand, it just seems inconceivable that your boyfriend stole from your employer without your knowledge. You may have an uphill battle to convince a judge of that.

You could contact your provincial human rights tribunal, or the Employment Standards Tribunal in your province for some free help. If you could prove that your termination was unwarranted, then your damages might include all maternity benefits, in which case it might be worth paying a lawyer to pursue the matter.

Unfortunately, too many questions remain unanswered to provide solid conclusions. In a nutshell, I would suggest talking to a lawyer.

Since your boyfriend caused you to lose your job, I suggest he work a minimum of 2 jobs to support both of you thu this mess. Why in this age of computers would anyone think they could steal a check and think they could get away with it, is beyond me. He probably thought, it is only $200 and the company wont notice it or miss it, but be it $200 or $2, it is still stealing.

Not only are you being blamed for this, you might not qualify for UI benefits. Also, when you go looking for a job, you now have this on your record from your prior employer and this could come back and bite you. My thought is that you should check out and see if this will be on any background check if you ever get another job.

I agree with the other poster and go to unemployment and talk to someone personally if possible to see if somehow you could qualify for UI benefits. Can you prove that the check was in his handwriting and not yours?
