Termination Without Cause?

Category: Law & Legal

Okay, what I want to know is if I have a case with the Ontario Labour board against my employer. Who last week informed me of my termination, I received written and verbal notice, both stating a "Shortage of work" and the inability to afford so many workers. So they had to fire 6 of us employees. A few days later we find out they've hired 3 NEW employees?

Do I have a case?

You sure do.........and a good one.......take the letter with you when you file..........shortage of work is not termination..........you will win this one........

Most employers hire you at will which means that they can terminate you at any time and do not have to have a reason.

If it was a shortage of work, they should have stated you were being laid off - a big difference on your resume than being fired - but for them to hire 3 replacements right away, sounds like they just weren't happy with the job performance.

But don't take it the way it sounded - it could've been a personal issue. I and quite a few others were laid off due to "financial" reasons, but hindsight shows that it was people that the boss didn't particularly like working with.

Good luck, Melissa. I hope you find something you enjoy even better than that last job. :o)
