If you get a ticket for shoplifting but it's a misdemeanor, and are trying to get a job- do you have to list it on the job application?

Note: I haven't gone to court yet- have i been convicted already? or do i wait to put it on job applications until i have gone to court?

A ticket is different than being convicted of a crime. Technically, it's like a motor vehicle violation though if you are convicted or plead guilty to shoplifting it goes on your record. Since it's not an "indictable offense" you may not have to list it on a job application. Ask your lawyer before you go to court, assuming you have one. You may need one or want to have one represent you since there's always the possibility you could get the charge reduced.

If you haven't been to court yet you haven't been convicted. What you should do is lie and not put it on your resume, since most retail jobs don't do background checks. Aim low.

Here is what you need to do. Get a lawyer and try your hardest to get him to negoiate with the judge and prosecutor to get the ticket changed to something else. Explain your situation, your forgiveness for what you did, be genuinely sorry. Right now you should try to get a job as fast as you can too so that you don't have to list it on your application.
