My former employer has withheld my wages from me.

He also was paying me and his whole staff ''off the books" which is not something I asked for or wanted when I interviewed for the job.

He offered me the job for minimum wage plus tips.

But now is using the LAW to deduct my tips.

He cannot have it both ways--

Work and hire illegally and not report taxes, info to government

But then have the audacity to use the law as a guideline to pay less than expected.

how do I get the pay we agreed upon? In the very least, how and whom do I report him too.

he is taking advantage of many and I'm sure has had complaints in the past.

He may be paying employees "under the table" but you (and these other employees) are as guilty of tax fraud as your employer if you haven't been reporting your earnings to the IRS, SSA, etc. Once you report your employer, you and all the other employees will have to pony up your share of monies denied these government entities.

The minimum employer contribution or wage is $2.13 an hour.... the employers portion plus your tips must equal $7.25 an hour or the employer must make up the difference......

i would imagine that there is simply a misunderstanding of what you were to be paid an hour BUT

if you have a written contract that states otherwise then proceed............

oh, NO written contract, then this is legal.....

what do you mean by "under the table", are you NOT reporting your income to the IRS?

if you are being paid and not reporting the income you are also in violation of the law.

the employer will owe for the businesses portion of your social security but you will owe your taxes, social security and medicare as well as any state taxes.......

there definitely are tax issues here but there is NOT a violation of the minimum wage law.
