7ala is fluffy ?7ala is fluffy ?

On Friday 11 of us at work were taken into the boardroom & told we were being made redundant - by a complete stranger, while our DM stood by & said nothing. (Hasnt said anything since to any of us either). We were told this was under TUPE rules, which i have since investigated, but i have some questions if anyone can help ?

1. My contract is with Prism, & has never been changed to my knowledge to AP, so how can Amethyst be making me redundant under TUPE rules? I worked on a team dedicated to AP, but am employed by Prism. The transfer of contract with AP to provide services does not alter the fact that I have a signed contract with Prism DM.

2. Amethyst have given the group of 11 people 1 months notice of intention, but one person has been with Prism contract for 10 years & legally she is entitled to one weeks notice for each year if employed between two and 12 years quote CAB ?

3. No formal letter of intent has been sent to me with my name on it, thats a legal requirement surely? Quote CAB & Acas.

Any other advice would be most helpful.

Thanx in advance......

I got made redundant on April 16th Not nice eh?

The best advice i can give you is this.

Do not put in an appeal or think of taking the matter to acas.

The reason is you have no have no employment rights that are these days properly enforcable by law.Companies can hire and fire at will..

If you try and fight it the company will just make your life hell and will look to take any disciplinary action they can with a view to firing you

It is better to cut your losses and run.Just get all the redundancy payment you are entitled to.

If you try and hang on and get unfairly dismissed it can take up to 2 yrs before your case is heard by a tribunal.Ok if you can afford to live on savings, but you should understand that any wages from a new job or benefits you recieve will be deducted from any compensation you recieve.

There are a couple of things you mention that seem very wrong. I would get advice from ACAS as soon as you can
