My job lost my check?

I got fired about a month ago for BS reasons, but anyway, i went on vacation right after and then waited a few days after that weeks check would have come in to get it. They told me they figured I wasnt coming for it so they mailed it to my house. I live a mile away, and it still hasnt come. Everytime I call my former employers they tell me that they will handle it. I call them every few days and still nothing.

So my question basically is, what should I do, and after how many weeks/months should I wait to do it?

Call the ex-employer and explain, politely, that if a new check is issued and available for you to pick up by 5:00 pm tomorrow that the next morning you are filing a wage claim with the state Department of Labor. Show up at 4:50 pm and pick up you check. If it isn't there file the claim.

Every country/state/province has their own wage laws - so you would need to find out what the law says the company must do with you last check. If you have not received it, you should ask the company for the original check number and the date it was cut, and as long as the check has not been cashed, have them stop payment and issue another check because you never received it. Do this after you become familiar with the law in your area that covers final wages so you can let them know that you are aware of the law and are only acting accordingly. If you are in the US, many states require payment immediately upon termination (if fired) or within in a very short time frame.
