Is this harassment? and what can I do?

I am on medical leave from work. I have doctors notes saying I cannot work. My boss has told me to my face I am faking it. She has turned the entire staff agaisnt me where they will not even acknowledge me. I recently found her facebooks page where it is post after post about my condition and how nothing is really wrong. Whenever anything happens medical wise to anyone on staff she tells the whole staff their personal buisness. Last time I was off work for losing my baby 4 months along, she even told me to suck it up it wasnt like it was born and an actual human yet I was making something out of nothing. I guess my question is what can I do? I have to go back in 2 weeks and I am dreading it, I know from my previous experience it will be a living hell and i will be talked about both to my face and behind my back, she is even driving by my house to see if my car is there and has followed me grocery shopping and tooks pictures. I just dont know my rights and what I can do please help.

I agree with the posters here. It's illegal what she's doing, and if there's any more of her **** you can hand her her @ss on a platter with a half-decent lawyer.

First off what kind of job is this?! If you are a professional, I would leave this job. It cannot be worth your stress to work in that kind of environment. I would definately write down, starting with the earliest incident you can remember, everything she has said or done to you that is innappropriate. I would write the dates or the approximates if you can. If you can copy and print from her facebook, do that as well. This is definately harrassment, but you need to have your case on paper to be looked at and taken seriously. You need to contact whoever is above her at your place of work and ask for an appointment to be seen to discuss some harrassment and unfair treatment you have been receiving at work. This is important!! Ask to be SEEN. Do not discuss this over the phone or email whatsoever! To be taken seriously you need to come across as professional and serious about your claims of mistreatment. The documentation will prove both the fact that it occured and that you have written proof of each incident, This is very scary to supervisors as they understand that this may lead to legal action or public complaints if they dont deal with it "in House" which means that they will speak to and possibly reprimand the boss who is saying and doing these awful things to you. If you dont get satisfaction from the supervisor be clear that you will pursue this further until it is dealt with diplomatically and properly. Do not be bullied ever in your workplace. There are rights and laws that protect you from this.

Talk to HR person, bring in all the evidence.

When you go back, you don't talk about what happened, show them you have the ability to work, but just unable to work due to medical condition. Believe or not, there are people who abuse the short term disablity, and that is why there might be some other co-workers "not" too happy about your leaves, because they think you used up their benefits.

Guess she never heard of the Family Medical Leave Act (FMLA).

You're working in a Hostile Environment. Illegal.

Start documenting. She told you you "were faking your illness?" Document, including her full name/title/date she made that statement.

Get on her FB page and get copies of any/all statements she's made before she deletes.

When you return to work, and there's any retaliation, including any verbal intimidation or negativity, keep documenting. If you see her car outside your house - snap away, including her license plate. Follows you grocery shopping? Keep your camera handy, turn around and take pictures of her taking pics of you. That's harassment, and basis for countersuing. Also document.

You're workplace doesn't have to be a 'living hell' when you return. Take matters into your own hands by documenting and sending copies to your 'boss.' She retaliates? keep documenting, and send copies to HR. Nothing's still not resolved? Keep documenting, send a copy to whoever's above HR. You're using the chain of command.

If you're fired on some unfounded charge, or because you 'dared' to speak up - seek legal council with your documentation. It'll be admissible in court as proof you worked in a Hostile Environment.
