Is my interviewer allowed to ask for my previous employer for a reference?

I was at an interview and the interviewer asked for my previous employer as a reference, though I did not include them in my list of references. Are they allowed to ask for that reference? My understanding is that they are not allowed to ask that question because I can put references that I want. I did give them four references. Their exact line of questioning was, Is your previous employer on this list of references? I said no. They said what is their name? and I answered with the persons name. I was uncomfortable answering this question as I left because of professional differences but really wanted this job. I heard that I can seek legal counsel if they don't hire me because of contacting references that I did not include. Thanks for any help.

You gave them the reference, so the rest is really a moot point |

Yes you can seek legal counsel if they contact a reference without your permission. But, I believe it would be difficult to prove whether or not they did. |

If you were the one hiring, would you really be happy hiring somebody if you knew nothing about their previous job. It is totally normal for a potential employer to contact the previous employer. |

Your understanding is wrong. They can ask for that reference. You can legally refuse to give them the name, but your chances of getting hired go to about zero. They don't HAVE to hire you. |
