Is it legal for an employer to take away vacation time?

I work at Walmart and I had 29.75 hours of vacation time available. I work part time and for part timers it takes 2 years to get one week of vacation. I have been working their for 2-1/2 years and have to take my vacation before October otherwise I lose it. I went to put in for my vacation and it was rejected, couldn't understand why. Then I looked at my paystub and it said I only have 5 hours of vacation available. My pay stub 6 months ago showed that I had the 29.75 of vacation time avalibal and now my current paystub is showing that I only have 5 hours available. I was getting a lot of hours back then, and they have been cut drastically, so if my hours are cut, is it legal for Walmart to just take away my vacation time. I was counting on that time and I have my paystubs from the last year to prove how much vacation time I was entitled to. If they don't honor my vacation time can I possible take them to smalls claims court and sue them. I don't want to sue, but will as a last resort.

It really depends on what state you are in, there are a few states that regard vacation time as wages and can not be taken away once they are given, in other states they can take it away at will

Companies are not required to give you vacation time at all, so it's absolutely legal for them to take it away.

In the US, there is no legal requirement for an employer to give you any vacation time so you can not sue.

However, I would take the two paystubs in to your manager an inquire as to where the vacation time went to.
