I need advice? Job discrimination?

I recently interviewed for a Cashier position at McGrath Lexus of Chicago. The interview went great, the hiring manager said that I am a good fit she liked me and to expect a call for second interview with the Assistant Manager. Yes they did call me for second interview went great too and I was told that they need to do a background check . The hiring manager even walk me to the door and assure me that everything is fine, like I almost get the job. Plus I am well qualified I worked as a cashier and bank teller before. Month ago I receive a security clearance to work at O`Hare airport so my background is just fine.

Then guess what nobody call me and after a week a see they put the Ad back again in Monster.com

I wonder the interviewer that came into the picture later (second interview) in the process didn't like me? She mentioned that I have a little accent ( who doesnt have it in USA), but that is not a problem. Can they legally discriminate me because of my accent or my nationality?

I call them 5 times and keep getting voice mail. That is not even professional . I often wonder would they treat their clients that way? At least they could answer the phone and let you know.

What is Really going on in America. This is not the first time something like this happens. I have been to many interviews and they all seemed to go very well. But a few days later or a week or so later i get a "sorry we chose someone else for the position" letter.

People make choices all the time - they use their discrimation. You can be discriminated against for a lot of things, and only a few are illegal. You can't legally be discriminated against due to race, color, religion, sex (including pregnancy), national origin, age (40 or older), disability or genetic information.

Having an accent is not a protected class, even if you could prove that is the reason you didn't get a particular job.

Ok, so you didn't get the job. Move on. If they did not say or do anything then you have no proof of discrimination. I am not sure why you would suddenly jump to that.

I can be hard to find a job. keep plugging away, you will get there

Unless the interviewer specifically said "Your accent may inhibit your ability to do the job," or something to the effect that she or he thought your accent would hurt you in the position or that the company preferred someone without an accent, then they did nothing illegal.

While not calling you back was extremely unprofessional and impolite, they are not required to hire you even if the interview seems to go perfectly. After pondering the situation, they may have just wanted someone else or to broaden their pool of candidates (hence the ad on Monster) so they'd have more of a choice.

In this day and age where companies have many people angling to apply for positions, it seems that they (the companies) have become extremely unprofessional in the way the applicants are treated. Of course you should have received a call back to let you know you were not chosen. Or they could have returned one of your calls. But they are not required to do either. As rude as that is.

Until they call you or send you a letter offering you the job for such and such money, you can never considered yourself hired. They would also want you to come in fill out forms for your W-2 etc.

Many good interviewers will make you feel good about the interview and hope that you believe you got the job rather than act like it did no go well or that they have several other candidates to interview also.

In one company I worked for they had a open house and over 95 people showed up and applied. There were people that were overly qualified and others that were not. One had been an airline pilot applying for an insurance job that obviously would have paid him less than he had made as a pilot. This was before the economy went down the toilet and unemployment is at an all time high, so employers can just "pick and choose" the absolute best and pay them less.

Even if you were to successfully get them on the phone and ask them, most likely they will tell you that they either found another person more fitted to the job or that they are still looking for someone that meets all of their qualifications and they felt you did not have. Just because you fit the job and was qualified, does not mean they believe that to be the case. I doubt your accent or nationality is a factor also. It is unlikely they would ever tell you the reason, so I suggest you just move on and hope that you find something better and not dwell on this.

You state "like I almost got the job" so there was no definite offer here then your additional details state "I will be getting hired".

Quit looking for excuses and put it down to the fact that they may have found a more suitable candidate if you don't get a definite answer shortly and move on.
