Does this fall under the equal opportunity employment act?

An announcement was made at my work place that a certain individual had been promoted to a managers position (a position this person does not have any real experience doing, they were an administrative assistant to the CEO). So this person is now my manager. Myself and many others feel that there is another person there that is more qualified for the position and was basically doing the job for the past year. No one announced that this position was up for grabs, it was just given to this individual. When asked why this other person wasn't given the opportunity - the CEO stated that they were unable to offer the position to him at this time.

I am concerned that they are playing favorites and passing up better qualified individuals. Does this fall under the equal opportunity employment act? If so, what can I do?

An employer can promote whomever they like whenever they like, equal opportunity act has nothing to do with it

Only if it was a matter of race, religion, or disability. Chances are there was some issues going on that you are not aware of. A company can hire whoever they want and it really isn't any of your business why the decision was made. One thing is certain is that if you make a big deal about it you may be handed your walking papers. The last thing managers need is the people under them second guessing thier decisions. You should congratulate the person who recieved the promotion graciously and do your job to the best of your ability. Let the person who got passed up make their own case.

A company can promote anyone they want to any position they want - they didn't break any laws - they could have just as easily hired someone from the outside

if that person is not qualified, it will show up in their performance and then senior mgmt will have to take action - or not

and since it seems like they promoted a woman, you would have a hard time claiming any violation of EEO rules

If the person who didn't get the job can show that it was given to someone else due to his race, gender, or other legally protected class, it might be an EEOC case. If it was given to the other person because of favoratism, even if they aren't nearly as qualified, there is no legal issue and no EEOC case.
