Death and Wages any advice please?

Hey guys, My dad died of a heart attack about 2 weeks ago and his wage was due to go in on Friday, however it did not. When I contacted the company they said they were not going to make that payment as he is no longer with them. Can anyone give me any advice as what to do?

As with any employee who leaves employment for any reason, wages are due for all time actually worked. Its possible that the company did not pay as usual because they need to adjust the payroll to only pay him for the part month.

Depending on your dad's contract he may also be entitled to additional death in service benefits.

It is the executors who are responsible for the estate. They have a legal duty to collect all debts due, so it is up to them to chase the employer for all monies due. If the executors are named in the will they do not need to wait for the grant of probate to start doing this.

If he worked the hours, he is due the pay and it should go to his beneficiary. You may need to get some legal advice. I would call them back and ask them why they aren't paying is wages to his beneficiary.

The wages are money owed to him and as he is deceased it now belongs to his estate.

Write a letter to human resources in that company explaining that.

However if they decide to keep the money it would be hard to take legal action, but a letter to a local paper would embarrass them into giving you the money.

If he had money coming from working hours he hadn't yet been paid for, then they are required to pay it to his estate. If they don't pay it, call your state dept of labor.

Any money/wages owed to him upto when he died should be paid and they would form part of the estate.

Contact the company and say that they owe any wages upto the day he died and if they refuse then go to your local CAB and get proper legal advise.
