If he gets deployed then he will get an increase in his pay and and the legal child support scale his payments to her would go up. but if they have no court order that states how much he has to pay right now and she's happy with what she's been receiving then he can keep paying her the same amount

You said there wasn't a order so that means that what he pays her is based on some agreement that they came to. If part of that agreement is that she get a percentage of his income then yes it will go up when he deploys because his income will go up. By that same logic when her returns and his income goes down so will the payments.

And she is free to tell her business anywhere she chooses but if I were you I would keep a paper copy of everything she writes about it. It may come in handy some day in court.

I also live in Dubuque Iowa for along time, and I got child support from my x husband whom was in the military and he got deployed...and I still got the same amount. But I never went to child support division to get more money. The basics are based on the mother and the fathers income. the child support division in Iowa goes by 27% of the fathers pay. So on that note I would say if she wants to be harsh about it she could go to the child support division and have them TRY to make him pay more since he would be getting more...but that process takes awhile...since they have not been through it at all.I don't know if this is his 6 month or longer. But if she does make him pay more then just be sure to have him adjust the pay rate back down when he gets back from deployment. On that's note make sure you are printing off the things she is saying about her spending the money on herself...that will hold up in court...if you should want to take legal action. If you are concerned, you need to speak to a family law attorney in your state. Coming here is a BAD idea for a dozen reasons. People are going to tell you what happened in their situation, but each situation is dependent on THEIR facts, not yours.

I suggest going to your state's child support division website and reading as much as you can. If he went through a recovery service through the state, they keep records of each transaction. He should be paying a third-party and they distribute the funds to her. He should not be paying her directly.

Child support gets reviewed automatically every couple of years for court ordered support. I know in Texas, you can request the Attorney General (who runs child support in this state) to review the non-custodial parent's salary at any time; however they will not raise the child support payment unless there is a significant change. I believe it has to be a change of $100 or more in the actual payment or a change of 20%. That is a significant amount when we are talking about pay increases. I can only say that here in Texas, court ordered or not, when you start a case with a child support agency, they will review it every couple of years and will review it at your request. I can't say whether or not that is the case in Iowa. The only way is to contact them directly and ask.

As for how the money is spent. You have ZERO control over how she spends the money. Unless you can prove that his children are being neglected by her spending habits, being used on drugs, so on and so forth...you can't control how she spends it. If the children are being fed, have proper clothing and shoes and all their basic needs are met, no amount of bickering is going to help. If you both truly despise paying for her spending habits, bring her to Court, get custody of the child/ren, and force her to pay child support. Otherwise, stop worrying about what she is doing and who she is bragging to. Adults DO NOT go peering into ex-wives' FB pages. Cut ties with the woman. If she wants to be trash, let her. Stop wasting your time and energy worrying about what she is doing and focus more on what the two of you should be doing.

Go to an attorney. Speak to the child support enforcement agency. Stop worrying about her drama. If he owes her more, he owes her more. There is nothing you can do about it unless you plan on fighting for custody.

If you truly just wanted to know about child support, you could have left the additional information about the ex-wife and how she spent the money out of it. None of us know you, or the specifics of your situation and the first time I read your question, you honestly sounded more concerned about how she was spending the money and whether or not she'd get more than really wanting a straight answer. Your fiance needs to settle this in court......a court ordered payment visitation program is essential.........if not you have to live with the drama.........simple...
