Child support raise in iowa if father deploys?
I live in Iowa with my fiance. He is currently deploying in August. He is paying child support to the mother of his child, not court ordered. He has contacted a lawyer because she is not letting him see his son and the money that she is receiving for her child, she is spending on herself. She has been constantly telling people how much she gets in child support all over the internet, which in my understandings I thought they couldn't do. But my question is, he is deploying and she is telling all of these people on FB that she is going to get more money and all she is going to spend it on and what not. In the state of Iowa if the father deploys does the child support go up? Even if it is tax free? And if so do you know if it is permanent or temporary? Thanks so much!

She's also going to get it retroactive since he hasn't been paying child support. |

If he gets deployed then he will get an increase in his pay and and the legal child support scale his payments to her would go up. but if they have no court order that states how much he has to pay right now and she's happy with what she's been receiving then he can keep paying her the same amount |

You said there wasn't a order so that means that what he pays her is based on some agreement that they came to. If part of that agreement is that she get a percentage of his income then yes it will go up when he deploys because his income will go up. By that same logic when her returns and his income goes down so will the payments. |

I also live in Dubuque Iowa for along time, and I got child support from my x husband whom was in the military and he got deployed...and I still got the same amount. But I never went to child support division to get more money. The basics are based on the mother and the fathers income. the child support division in Iowa goes by 27% of the fathers pay. So on that note I would say if she wants to be harsh about it she could go to the child support division and have them TRY to make him pay more since he would be getting more...but that process takes awhile...since they have not been through it at all.I don't know if this is his 6 month or longer. But if she does make him pay more then just be sure to have him adjust the pay rate back down when he gets back from deployment. On that's note make sure you are printing off the things she is saying about her spending the money on herself...that will hold up in court...if you should want to take legal action. Anything she ever does negative towards you guys or his child should be documented. Best of luck to you.....Venessa. |
