Can my boss give me a bad reference?

The company i work for is carrying out an investigation after a letter on the desk of the boss was disclosed to the member of staff it was about.The member of staff refuses to disclose who told her about the letter.The company has now said if anyone leaves during the investigation it will be put on there reference they were under investigation.Can they do this? and can they discipline the member of staff who refuses to disclose who told them?

Yes they can do this... Whether they should do this is open to discussion. If your boss writes anything "Defamatory, libellous, or untrue ..." you could sue and he will/should know this.

If he wrote what he threatens to write, it would be true... but, a decent lawyer could throw a different light on things given half a chance and enough cash! (He will/should know this too!)

THey can not write a BAD reference about you. However they can refuse to give a reference, or write on the reference that PERSON A worked for the company between (This date) and ( That date).

This would then give an indication to the new company that something was not right, as most people who give genuine reference would say a little about PERSON A.
