Can i raise a grievance regarding contractual sick pay?

Hi this is my first post here any advice on this matter would be greatly Appricated!!
According to my contract i get 13 weeks full company sick pay from April to April each year when this is exhausted it drops to SSP for 26 weeks. I had a bad accident last year (May 09) in which i was off work for 10 weeks, i have now been signed off by my GP from 3rd of March 10 to now and the company has stopped my pay and put me on ssp since the 21st March by this date i have used up 13 weeks in last financial year (1st April 09 -1st April 10), my contract states i get 13 weeks every April but because i was signed off from 3rd of march 2010 HR have said that i fall into last years bracket and that i would have to return to work to get this years entitlement! i am hoping to return to work asap, but in the mean time i am meant to live of ssp (79.50 per week!) i live alone and this is impossible, my contract clearly states that as from 1st april 2010 i should have 13 weeks for this new financial year, can they do this? i am thinking of rasing a grevience for unlawful deduction from wages but i'm not sure if this is the way to go, can anyone help me on this?

Since you are receiving the statutory minimum this is therefore a contractual matter. As your company chooses to pay more than the minimum it is entirely up to them how they minister their own scheme. |
