Can an employer make you work evening rotations if you were hired to work days?

I was originally hired to work 8:30am to 5pm. Then mutually agreed to work 8:15am - 4:45pm and once again mutually agreed to work 8am - 4:30pm all in under a three year period. On occasion I have agreed to and worked holidays and Saturdays. Now my employer wants me to work evening rotations two days a week 10-7or 8pm. I strongly do not want to work these hours. They remind me and my co-workers they can fire at will and we need to work those hours, though my 8-4:30pm hours still meet the needs of the business. They don't want to hire someone for 10-7 stating it wouldn't be fair? They want to hire a person to work rotations with me. Is this legal? They say that they are sorry I've had hours changed so often and feel upset but there is no negotiation and I am free to search for other jobs. I fear I'll be fired or mistreated at work if I don't do as they say. Are there USA laws that protect my rights? Do I have rights?

Nope.........you said it.......meets the needs of the business.........if you find that unacceptable you are free to go elsewhere and they are free to terminate your employment........

Being that they are "at will" you might as well work the evening hours they are wanting unless you really dont want the job...

If what happens goes against the contract then its illegal. however you decided and agreed to work at night already when they asked you to, which means the contract is pretty much without power. your choices are to find another job, since you are free as you said without the cover of the three your contract, or adapt your rooster at the moment.

If you are in a "work at will" job (not part of a union or under contract) then your schedule can legally be changed at any time, with or without warning. If you are a union employee, you should talk to your union.

Also, because every state has their own labor laws, you should contact the government agency that oversees those laws and find out specifically what your rights, and responsibilities are with regard to schedule.

The only problem I see would be if you had children who were in childcare and were penalized for paying over a certain time.

ie; many childcare centers will charge $1 per minute over 6 pm.

But it appears that this is not an issue, or you would have stated so. Your employer has a business to run and to make a profit so he can pay your salary. Your complaints of them changing the schedules is only minimal of a couple of hours per day/week.

Everything they are doing is legal and as long as they pay you for your hours or any overtime, then they are complying. It sucks, so if you don't like it, then find another job working the hours you want.

Unfortunately, grace, if you want to keep your job there, you're going to have to comply. you can tell them you disagree with their decision and perhaps try to convince them your idea is better, but chances are their minds are made up.

working the afternoon or evening shift a couple of days a week isnt so bad. you can sleep in a little later in the morning and get some things done at the quieter time of day. I worked afternoons for one year and I quite enjoyed having my morning time.

try it for a while and if it doesnt work out for you it will be their loss. remember, when one door closes, another one opens.

Of course it's legal. Your RIGHTS? What about THEIR rights to run their business however they think is best? Your right in this situation say that you can quit if you want to rather than work the new schedule.

The employer sets the schedule, you don't. And if they change your hours and you refuse to work the new hours, they'll fire you and replace you with someone who will. You most likely would not be approved for unemployment if that happens.
