Can I sue my boss for.....?

Okay so I've been working at this place and the law in my state says that anyone under 16 can't work past 7 on school night, but many of times I have had to work untill 11 (the store closes at 10 but some customers dont leave until 11) and when I would clock out at 11 he would only pay me until 10. Could I sue him for not paying me that money for those hours, and having me work past legal hours?

NO you can NOT sue your employer for working you past 7pm that is a violation that the state will deal with...... there is no loss for you to seek any kind of damages for on this issue.

you can file a wage claim (and should) and in some states you can go to small claims court for the wages not paid.... it is easier and much more cost effective to file the wage claim. you will get the wages owed much quicker filing the wage claim then any type of civil suit............

states take child labor violations very VERY seriously......

I had a boss who did not let me go to lunch when I was 15, and I told him there were laws against it. He said he did not even have to hire me or keep me if he did not want to do so. There are child labor laws. I do not know what state you live in, but I would contact someone about it and ask them what the law says about it.

Definitely bring a lawyer into this! He can't NOT pay you for time that you're there, even past closing.

He is obligated to pay you the hours that you work under Federal and State law statutes. If you agree to work past 7 p.m. that is likely between you and him as most states don't address that, although you say your state does.

You should probably just quit if that's happening. If you attempt to sue them you'll only waste money for court fees and when your employer's lawyers have your case denied you'll be fired.

Unless there are weird laws in your state, virtually always you MUST get paid for time worked, they can't say, oh leave early tomorrow, they have to pay you. Also, especially if you put on your job application you can't work past 7, he's in a lot of trouble because you are legally a minor. Why don't you talk to your parents about this.

Yes, you can but you need evidence. Make sure you have proof you worked those hours (aka documentation) before confronting your employer, quiting, or hiring an attorney. Once you take action an employer will generally try to cover there tracks very quickly.

You may not be able to sue and get money but if you report it you can definately get the person in major trouble because it is illegal.. Also I believe you can just leave when you've worked your shift and if he fires you you can collect unemployment because he was doing something illegal in the first place

Contact the labor Department of your state immediately

They will fine them for making you work late and would help you get your lost wages

Also you might contact the attorney general of your state

You might as well learn now that you don't just sue people who do something they aren't supposed to. You can report him to the state department of labor and get him in trouble, but no you don't sue him for something for this. And yes he should pay you for all the hours you worked.

You could go to him and tell him that you want your pay for the hours you weren't paid for, and if you don't get it you'll report him to the state.
