Can I be sacked for applying for new jobs?

I have applied for & got a new job. I phoned my boss & told her that the new company would be asking her for a reference. I have not actually handed in my notice yet though. I've since been told that I am going to be made redundant so would like to stay to get my lump sum payment. Can I do that? can my company sack me? UK answers only please.

Now, you sound like you are upset because of the redundancy but you have another job to walk into. Assuming that your references are good, this is great news all round.

Chances are that your boss (or someone) has been given a number, either £££ to save or staff to make redundant and this is a very hard decision to make. Your new job offer has come at a good time for your boss - an easier decision, they can make you redundant - no hard feelings since you were going anyway - save money but also - and this is the good bit - you might get some redundancy money out of it!!

Now legally once you have been given notice that you are going to be made redundant I think you can leave at any time during the notice period, and you have to be given time off for interviews - they can't hold you back from looking for a new job.

Redundancy is not sacking - redundancy is that there isn't enough work and is not your fault, Sacking is where you are at fault and have left the company in a position that they have to get rid of you (like stealing from them for example).

Now when does the new job start and when is the old job likely to end? If you can get the 2 to be on a friday -monday of the same weekend than you are laughing, take the redundancy and start the new job.

I would talk to your current HR department to find the guidelines for you leaving with a payment, and the earliest you can go with that, and also find your expected start date for the next job, then negotiate with your current employer to give you a finish date when you need to. The fact that you haven't handed in your notice before you were put at risk of redundancy is good - now legally I think you can have the cash togo.

One last thing - are you 'at risk of redundancy' or are you being made redundant? Slightly different and again worth finding out from HR

If they are making you redundant then they are saying that the position is no longer necessary.

No, if they sacked you for that, they would be breaking the law and you could take them to a tribunal. You are allowed to apply for other jobs, there's nothing to stop you.
