Any law buffs out there who nows anything about Gross Misconduct?
My mate was sacked for making a rude remark during a conversation with another male regarding a female. The female in question had been very open about her various construction of her lower regions and had told almost everyone in the office about it.
However she found out about the conversaton and reported my mate, he had worked for the company for 36 years with no disciplinary issues.
Very very harsh in my opinion - He is going through the unfair dismisal route

Did he have a proper disciplinary - and was he allowed a person in with him? Has he got any witnesses - he will need to ask them if he takes it to Tribunal? Did the company allow him to apologise? I am mid way into the Tribunal process - if you need help - email me and give me full details. |

I am not sure what comment he made, but the laws lean very heavy in favor of women. A woman can say anything she wants about herself and be very descriptive but if a male repeats it, he is in for it. If he feels very strong that he has been treated unfair, he should bring a lawsuit against the company and against the woman. If he wins he won't need to work. |
