Can they force someone to go to a nursing home?

If a man is over 70, and in a wheel chair, can the wife force him to go in a nursing home, if they both own the house legally? He is in a wheel chair, but he can't shop, but he could pay someone to bring the groceries. My basic question is this. If he owns the house, can they make him leave it and go in a nursing home, if he doesnt want to go???

In all honesty I am not sure. However, I would recommend that you check with an attorney, a patient advocate or adult protective services. APS is probably who I would contact first. They will be able to advise you as to the rights and regulations regarding the gentleman in question.

Usually patients are much happier if they are allowed to remain in their own home. Although unfortunately, depending upon the amount of care he needs, this is not always possible.

It depends on his mental ability to make decisions for himself and his financial ability to get himself assistance.

I have no idea where you live, but I don't think home ownership plays a role at all. Rather, it would be more about his capacity to look after himself. Since we don't know where you live, we can't really tell you what the laws are. Unfortunately sometimes people just aren't able to live independently, even with a lot of support.

I honestly don't know. But if he's considered legally competent, then I'm guessing no.

There ARE ways in which people who don't want to be, are put in nursing homes. In fact, have you ever heard of a person who WANTS to live in one?

Medicare has set criteria, which deal with a person's physical and mental ability to take care of himself. Simply being able to dress himself also includes doing the laundry, and feeding himself includes shopping for groceries and cooking and cleanup. Being able to bathe, and take care of personal hygiene needs is crucial to being independent. Beyond physical disability, there are mental disabilities, even just being frustrated by his inability to do his own dressing, bathing, eating, hygiene, etc.

From the tone of your question, you are totally discounting the wife's physical ability and mental willingness to do all those things for him that he cannot do for himself. If a man allows his frustrations to cause him to treat his wife badly, she may not feel like doing for him everything he cannot do for himself.

You say he "could" pay for in-home care. Why is he not doing that already? Does he expect his wife to wait on him hand and foot, with no consideration for her own lack of physical strength, and her need for emotional comfort, that he is not giving her?

People who are unable to do what they used to do, often become frustrated, unhappy, self-centered, selfish and self-pitying. They can be hell to live with, especially if they blame their problems and inadequacies on their mates.

YES, he can be forced into a nursing home if his physical welfare is in danger, or if he is a danger to himself or others. If he is mentally unable to take care of everything he needs to live independently. I would think, this is done only through the courts if he can truly object effectively.

The real problem is usually money. It costs 4 or 5 times as much to live in a nursing home as it does to live in a home that's paid for. It is often the case that paying for the care of one partner in a marriage takes everything, and leaves the other partner impoverished, even homeless.

If he is in his right state of mind, then no. No one can force him to go into a nursing home.
