IS there a chance I'm eligible for unemployment benefits after this happened ?
I'm in NYS, and ALL of us were laid off Jan.1st, 2010 due to a program being cancelled. On the phone they told us we all qualified for UI. {I worked almost 2 yrs. w/this same position in company].
I didn't collect right away because I preferred to work {of course}. So the same company offered me a job March 2010. They gave me a general description of job, I accepted.
HOWEVER in the midst of my ONLINE training for 1.5 hrs. + 1 hr. conference call which I completed, the manager emailed me a route list in which several towns within the territory of my route list were closer to PA [ny bordering PA].
I emailed her telling her my car wasn't in shape to travel such far distances and I was with the understanding that my route would be within the county in which I live. {because this is what she implied to me before I accepted the job.
SO, with that being said, I never officially started my job on route, though just went through 2.5 hrs. of training.
I kept looking for jobs and so far no one has called me [b4 this economical situation I always got jobs VERY fast!}.
SO I filed for unemployment benefits and have received 3 weeks worth so far.
TODAY I GOT A LETTER FROM THE UI OFFICE w/a notice that this company claims I quit!
I actually never started the other job all except for the quick 2.5 hrs. And thought the UI was based on my previous job w/this company in which I held for almost 2 YEARS!
SO WILL I BE ABLE TO STILL COLLECT UNTIL I FIND A JOB WHEN I EXPLAIN THIS TO THE UI OFFICE AND FILL OUT THE FORM? OR WILL I HAVE TO PAY THE STATE BACK? { I live in NYS} thank you. PLEASE experienced individuals help thanks.

I would apply for the unemployment and see what happens. In my state, you get a call from a claims examiner who checks your story against you former employer's story. If they tally up, IMO you will be able to collect. It will help for you to be able to show a copy of that email to the unemployment office. |
